PRIVACY POLICY

This Privacy Policy is part of the User Agreement (hereinafter – the “Agreement”), available at https://myward.com/privacy-policy, which sets out the terms of use for the MyWard mobile App (the “App”), by accepting the terms of the Agreement, you consent to the processing of your personal data in accordance with the terms of this Privacy Police.

We may update this Privacy Policy at any time by posting a new version on the App. You should check the App periodically to ensure that you agree to any changes to this Privacy policy.

If you do not agree with any terms of this Privacy Policy, you must immediately stop using the App and notify us of your intention to stop the processing of your personal data.

1. General terms

1.1.

This policy describes the sources of your personal information that we may collect from you or that you may provide to us, our purposes for collecting and processing your information, and our practices for collecting, using, maintaining, retaining, protecting and disclosing that information.By accessing or using our App, you agree to this Privacy Policy.

2. What information we collect about you?

2.1. Personal information you give us, namely:

a) Your gender.

b) Your email address.

c) Records and copies of your correspondence (including e-mail correspondence), when you contact us.

d) Information that you provide when you contact us via social media or support service for general enquiries, register complaints, request for any assistance/ services. Information may include your name, country, email address, contact phone number.

e) Information that you provide to surveys that trigger for feedback to help us improve ourselves.

2.2. Other information we collect.

There is other information we may collect that does not directly reveal your specific identity or does not directly relate to you as an individual.

We may automatically collect the following information when you use App:

(a) Your geolocation;

(b) Language used;

(c) Cookies (small files stored in the memory of your device, designed to personalize your activity and behavior in the App and Stores).

2.3.

You are solely responsible for updating and maintaining the correct information in your Personal Account in the App. You may amend Your personal information at any time in your Personal Account.

3. The purposes for which we use your personal data:

3.1.

We may use your personal data for the following purposes:

3.1.1.

Your Identification for entering into and performance of the Agreement with you;

3.1.2.

Registration of Users in the App;

3.1.3.

Providing access to the User`s Personal Account;

3.1.4.

Providing the User with the opportunity to use the functionality of the App.

3.1.5.

Performance of the terms of the Agreement with you, including the following activities required for due performance of the Agreement:

a) Promotion of the App and services, including informing you about new products, new functions of the App;

b) Development, improvement, modernization, updating of services and products;

c) Informing you in connection with performance of the Agreement;

d) Analysis of the consumer market with consideration of your personal data and using the App for marketing of our products and services (hereinafter referred to as the "Market Analysis");

e) Compliance with the requirements of the applicable law or the decision of a court or other competent state or municipal authority.

4. Methods of Your personal data processing

4.1.

The way we use your personal data depends on the specific purposes for processing it.

4.2.

To fulfill the purposes specified in paragraphs 3.1.1. - 3.1.4. hereof, we must obtain sufficient information to establish your identity, indicated in paragraphs (a) and (b) of clause 2.1. hereof. We collect, record, store and systematize this information through automated means as well. Such personal data is processed until termination of the Agreement in accordance with terms and conditions of the Agreement.

4.3.

To fulfill the purposes specified in sub-clause 3.1.5. hereof, we shall process the information specified in paragraphs (a) - (e) of clause 2.1. hereof, (a) - (c) of clause 2.2. hereof. We collect, record, systematize, accumulate, and use the personal data listed above. We may use aforementioned personal data to send notifications to your e-mail address, which may concern the operation of the App, new features of the App and special offers for the App users. The aforementioned personal data is processed until the termination of the Agreement in accordance with the terms of the Agreement

4.4.

We only process your personal data if one of the following conditions is met:

  • You have given your consent to process Your personal data as provided for in the Agreement.
  • The processing of your personal data is required for the performance of the Agreement.
  • The processing of your personal data is necessary in accordance with the requirements of the applicable law, a decision of a court or other competent state or municipal authority.
  • You have made such data publicly available and accessible.

5. Protection of personal data confidentiality

5.1.

Recording, systematization, accumulation, storage, improvement (updating, modification), extraction of your personal data is performed with the use of databases located on the territory of United Arab Emirates.

5.2.

We take reasonable and appropriate administrative, technical, organizational, and physical security and risk management measures in accordance with market standards and applicable laws to ensure that your Personal Data is adequately protected against accidental or unlawful destruction, manipulation, damage, loss or alteration, unauthorized or unlawful access, disclosure or misuse, and all other unlawful forms of processing of your Personal Data in our possession.

5.3.

We establish control access to our facilities and applies secure destruction to media containing your personal data. We use network and information security technologies, monitors the systems and data centers to ensure that they comply with security policies. The technology safeguards are continuously adapted and improved in line with technological developments.

5.4.

We conduct regular security and privacy training and awareness programs to ensure that the our employees and contractors understand the importance of protecting Your personal data, and that they learn and maintain the necessary knowledge and skills effectively to protect it in practice.

5.5.

We apply policies, standards and supporting security controls at the level appropriate to the risk level and the services provided.

5.6.

We take all reasonable measures to prevent personal data breaches. The measures we take include:

  • Placing confidentiality requirements on staff and service providers;
  • Restriction of access to personal data to employees and third parties strictly on a need to know basis;
  • Destroying or anonymizing personal information if it is no longer needed for the purposes for which it was collected;
  • Using secure communication channels for transmitting personal data.

6. Cookies Policy

6.1.

We may use cookies or similar technologies. Cookies are small text files that are stored on Your device and provide us with the ability to track, store, and collect information.

6.2.

The cookies may be used for recognizing that you have signed in to Your Personal Account so that you do not have to log into Your Personal Account for a period of time, to provide analytics and reporting and remember options you have selected for Your Personal Account settings.

You may control cookies at the browser level.

7. Your rights in respect of Your personal data

7.1. You may realize the following rights in respect to Your personal data upon Your request:

7.1.1. The right to access.

You have the right to obtain confirmation as to whether we process personal data about you, receive a copy of your personal data held by us, and obtain certain other information about how and why we process your personal data.

7.1.2. The right to rectification.

You have the right to request for your personal data to be amended or rectified where it is inaccurate (for example, if you change your name or address) and to have incomplete personal data completed.

7.1.3. The right to restrict processing.

You have the right to restrict our processing of your personal data in the following cases:

  • Temporarily for a period when you have contested for the accuracy of the personal data;
  • Temporarily for a period when you object to the pricessing of personal data if your personal data has been unlawfully processed and you request that the processing be restricted instead of deleted;
  • The personal data are no longer necessary in relation to the purposes for which they were collected and processed but the personal data are required by you to establish, exercise or defend legal claims.

We can continue to use your personal information following a request for restriction, where:

  • we have your consent; or
  • to establish, exercise or defend legal claims; or
  • to protect the rights of another natural or legal person.

7.1.4. The right to erasure.

You have the right to request the deletion of your personal data. We are not required to comply with your request to erase personal information if the processing of your personal information is necessary:

  • For compliance with a legal obligation; or
  • For the establishment, exercise or defence of legal claims.

7.1.5. The right to object to processing.

7.1.6. The right to data portability.

You have the right to receive your personal data provided to us and have the right to send the data to another organization (or ask us to do so if technically feasible).

7.1.7. The right to withdraw consent

To the extent that the legal basis of our processing of your personal data is consent, you can withdraw that consent.

7.1.8. The right to lodge a complaint with a supervisory authority

If you are not content with how we manage your personal information, you can lodge a complaint with a supervisory authority in your country of residence, place of work or the country in which an alleged infringement of data protection law has occurred.

7.2. The right to lodge a complaint with a supervisory authority

We take all reasonable measures to ensure realization of Your rights in respect of Your personal data. If you would like to access the above rights, you may contact us by mailing us at email address which indicated in Section 8 of this Privacy policy. We shall aim to comply with all requests within reasonable time in-line with applicable laws. However we may not be able to fully fulfill your request, for example, in the following cases:

- if it would impact the confidentiality we owe to others;

- if we are legally entitled to deal with the request in a different way;

- if your request involves deletion of information that are required to comply with the legal requirement.

We will make every reasonable effort to honour your request in-line with applicable laws.
